SongSurprises is an online service that lets users create personalized songs based on descriptions, requests, stories, themes, moods, lyrics, and other user-provided content.

The service may include AI-based tools or automated means for creating lyrics, song concepts, vocals, arrangements, and other creative content.

By using SongSurprises, you confirm that you have read, understood, and accepted these Terms. If you do not agree, you may not use the service.

You may use the service only if you are legally able to enter into binding agreements under the laws applicable to you.

If you use the service on behalf of a company or organization, you confirm that you have the authority to accept these Terms on its behalf.

You may submit requests, stories, descriptions, names, lyrics, themes, occasions, and other content for creating a personalized song.

You are fully responsible for the content you provide. You agree not to submit content that:

• infringes intellectual property, privacy, or other rights;
• is defamatory, offensive, hateful, fraudulent, or misleading;
• contains viruses, malicious software, or harmful code;

SongSurprises generates content based on your input and automated generation systems. Due to the nature of digital and AI generation:

• results may vary from request to request;
• the quality, style, and accuracy of output are not guaranteed;
• generated content may not be unique;
• similar or overlapping results may be generated for other users;
• before public or commercial use, the generated content may require your review.

You agree not to use SongSurprises to create, request, upload, or distribute content that is illegal, offensive, infringing, misleading, or otherwise harmful.

You also agree not to:

• attempt to interfere with or disrupt the service;
• obtain unauthorized access to systems or accounts;
• reverse engineer or abuse the platform;
• use automated scraping or data extraction without permission;
• use the service for fraud, spam, or impersonation.

Some parts of the service may be available without registration, while others may require an account, purchase confirmation, or email-based access.

If you create an account or otherwise access protected sections of the service, you are responsible for keeping your credentials confidential and for actions taken under your account.

Some SongSurprises features are paid. Prices, packages, and included features are shown on the site at the time of purchase.

Payments may be processed by third-party payment providers, including Lemon Squeezy or other providers we use. We do not store full payment card data on our own servers.

By making a purchase on SongSurprises, you agree to provide current, complete, and accurate payment information and authorize the corresponding payment for your order.

Because SongSurprises provides digital and personalized content, purchases generally cannot be refunded after generation begins, content is delivered, or digital access is provided, unless required by applicable law.

Refund requests may be considered in limited cases, such as:

• duplicate charges;
• technical failure causing non-delivery;
• billing errors;
• cases where a refund is required by law.

All rights, title, and interest in the SongSurprises website, branding, software, design, copy, layout, and service infrastructure belong to SongSurprises or its licensors and are protected by applicable law.

You retain ownership of the content you provide to the extent you already own or control it.

By providing content to the service, you grant SongSurprises a limited, non-exclusive license to use, reproduce, process, modify, transmit, and display that content solely as needed to operate, provide, maintain, support, and improve the service.

Subject to these Terms and applicable purchase conditions, you may use the generated output provided to you through the service for personal purposes.

Commercial use may be restricted, unavailable, or require a separate license depending on the plan, feature, or offer in effect at the time of purchase.

If you intend to use the generated content for commercial, advertising, public, or monetized purposes, make sure that the chosen plan or license allows such use.

SongSurprises may use third-party providers for payment processing, hosting, analytics, authentication, content delivery, and AI or music-creation infrastructure.

We are not responsible for third-party services, sites, or tools, except as required by law. Your use of these services may also be governed by their own terms and privacy policies.

We may update, modify, suspend, or discontinue any part of the service at any time, with or without notice.

We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

SongSurprises is provided "as is" and "as available".

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

We do not warrant that the generated content will meet your expectations, be unique, suitable for a particular use, or free from similarity with other content.

To the maximum extent permitted by law, SongSurprises and its owners, operators, affiliates, licensors, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, or other intangible losses arising from use of the service.

To the maximum extent permitted by law, our aggregate liability for any claim related to the service will not exceed the amount you paid SongSurprises for the specific purchase or service that gave rise to the claim during the 12 months preceding the event giving rise to the liability.

You agree to defend, indemnify, and hold harmless SongSurprises and its owners, operators, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from:

• your use of the service;
• the content you provide;
• your violation of these Terms;
• your violation of the rights of any other person or entity.

We may suspend, restrict, or terminate your access to the service at any time if we believe you have violated these Terms, abused the service, created risks for us or others, or if required for legal or operational reasons.
